![]() This means you have to be especially careful around the month of February: If you are planning to tell your tenants that they must be out by March 1 for a reason other than non-payment, that notice will have to go out in late January to keep you in compliance with the law. However, for all other issues, you must allow 30 days or one full rental period, whichever is longer. You can still issue a 14-day notice to quit for nonpayment. If your tenant does not have a lease, they are a tenant at will, and the rules are a little different. These reasons include guns, drugs and prostitution. Under a lease, you can give a tenant a 14-day notice to quit for non-payment, and a 7-day notice for other reasons if they are already written into the lease. If you are looking to evict a tenant who has an active lease with you, then you should always follow what your lease says. However, not all notices apply to all tenants, and not all notices can be used for non-payment of rent. There are three types of eviction notices: 7-, 14- and 30-day.
